Terms and Conditions

1. Product Specifications

All product specifications are subject to change without notice. If matching to a previous procured item is required by customer, customer must specify this requirement.

 

2. Delivery

A delivery charge is levied for delivery into store in the Melbourne area or into a Melbourne freight depot. Outward freight is the responsibility of the purchaser.

Delivery to high rise building in the CBD requiring the use of lift may also be subject to additional charge based on time incurred.

Where goods are consigned to a purchaser by a carrier or an authorized person, the delivery shall be deemed to have been effected and at the risk of the purchaser from that point. The carrier or authorized person shall be deemed to be the agent of the purchaser
Estimated ex-factory dispatch is approximately 3 to 4 weeks subject to material and fabric availability and market conditions.

 

3. Return Goods

Goods are non-returnable unless by prior arrangement with Folioworks Pty. Ltd. and an authorization reference by fax or email obtained. This reference must accompany the return of the goods. Freight for the returned goods is the responsibility of the purchaser.

No claims for damaged goods will be recognized unless advised in writing by the purchaser within 3 days of the date of invoice or from the date of dispatch.

 

4. Retention of Title

Goods supplied remain the property of Folioworks Pty. Ltd. until payment in full of the purchase price and any fees charged in accordance with these conditions is made.

 

5. Cancellation of Order

Goods once ordered shall not be cancelled, unless a written notice is received by Folioworks Pty Ltd within 3 days from the date of Confirmation of Order. Purchaser shall pay the full price of the ordered goods on demand. In the event of any forced cancellation of the order, the goods shall be auctioned and the proceeds from the resale shall be credited to the purchaser.

 

6. Warranties

All products manufactured by Folioworks Pty Ltd carry a 3 year structural warranty for steel products, 2 years warranty for timber products and materials. No warranty is extended to the fabric.

Products claimed to be faulty within the warranty period must be returned to the nearest factory/warehouse of Folioworks Pty. Ltd. at the Purchaser’s expense. Repair or replacement will commence only after an examination that the products are found to be faulty due to the material or manufacturing process.

 

7. Terms of Payment

8. Interest Charge for Late Payment

An interest of 2.0% per month or part thereof shall be charged on overdue accounts exceeding the agreed trading terms.

 

9. Debt Collection Expenses

Purchaser shall pay to Folioworks Pty. Ltd. any commissions, solicitor’s fees, court costs or other collection expenses paid by Folioworks Pty. Ltd. in relation to the collection of any monies that are not paid within the Terms and Conditions of Sale.

 

10. Exclusion of Liabilities

To the extend the law permits and notwithstanding any other clauses of these terms and conditions, Folioworks Pty Ltd excludes all liability whatsoever to the purchaser arising out of or in any way connected with a contract for any consequential or indirect losses of any kind whatsoever arising and whether caused by breach of statue, breach of contract, negligence or tort. Consequential or indirect losses shall be taken to include but not limited to: any loss of income, profit or business; any loss in the nature of overhead cost; and any loss of goodwill and reputation.
